Conditions of Use – Website and Online Systems
Background
- Tennis Coaches Australia (TCA) provides access to this Website and Online Systems for the benefit of tennis coaches and other tennis stakeholders. This Website and Online Systems are generally operated by TCA on servers in Australia but may also be operated by third parties contracted by TCA from time to time, using servers both in Australia and overseas.
- YOUR USE OF THE WEBSITE AND ONLINE SYSTEMS PROVIDED BY TCA IS SUBJECT TO THESE CONDITIONS.
Conduct
- TCA wants everyone who uses the Website and Online Systems to have a safe and enjoyable experience and needs your help to ensure this is the case. As such, in using the Website and Online Systems you agree that you will not:
- a. post content that is:
- i. hate speech or racially offensive;
- ii. threatening;
- iii. pornographic, profane, or contains nudity or graphic or gratuitous violence;
- iv. likely to or intended to incite violence;
- b. use the Website and Online Systems for any improper or unlawful purpose, including:
- i. stalking, harassing, bullying, or discriminating against other users;
- ii. misleading or deceptive conduct, defamation, libel, or a breach of confidence.
- c. impersonate any other person or entity while using the Website and Online Systems;
- d. upload viruses or other malicious code designed to damage the Website and Online Systems;
- e. do anything that could disable, overburden, or impair the proper working or appearance of the Website and Online Systems;

- g. collect content from the Website and Online Systems using automated means (such as harvesting bots, robots, spiders, or scrapers); or
- h. post unauthorised commercial communications (such as ‘spam’ or advertisements) on the Website and Online Systems.

TCA may delete any content from the Website and Online Systems at any time (in its sole and absolute discretion).
Intellectual Property
- Copyright in all components of the Website and Online Systems is owned or licensed by TCA unless otherwise indicated.
- You must not copy, modify, or transmit any material from the Website and Online Systems without TCA’s consent. In particular, you must not incorporate any material from any part of the Website and Online Systems in any commercial work or publication, and no material may be distributed or copied for any commercial purpose. You may save, print, copy, or reproduce material solely for your personal (non-commercial) education or information.
- The Website and Online Systems contain trade marks which may be registered or otherwise protected by law. These include the TCA logo and the logos of tennis tournaments. You are not permitted to copy or use these trade marks.
- Where you are invited to submit any contribution to the Website and Online Systems (including text, photographs, graphics, video, or audio) you agree, by submitting your contribution, to:
- a. warrant to TCA that your contribution is your own original work, it is not defamatory, it does not infringe any law, and that you have the right to make it available to TCA; and
- b. grant TCA a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, distribute, and exercise all copyright and publicity rights with respect to your contribution worldwide. If you do not want to grant TCA the rights set out above, you should not submit your contribution.
- You are not permitted to publish links to the Website and Online Systems on your own websites or systems without TCA’s express permission.
Personal Information
- TCA respects your privacy. The personal information you submit while using the Website and Online Systems will be collected, used, and disclosed in accordance with any privacy statement disclosed to you and the TCA Privacy Policy, which contains information about how you may access and seek correction of your personal information, how you can complain about a breach of your privacy, and how the complaint will be dealt with.
- In certain limited situations, the information that you submit may be made publicly available in accordance with the TCA Privacy Policy. For example:
- a. if you are a coach member of TCA, your business and contact details may be advertised to prospective participants; or
- b. if you are a tennis player with TCA, your name, age/year of birth, or location may appear on tennis rankings, tournament schedules, competition schedules, and results pages.
- It is your responsibility to keep your personal details, including contact information, accurate and up-to-date so TCA can most effectively communicate with you and operate the Website and Online Systems for your benefit.
Anti-Spam Notice
- You must not use any personal information (including, but not limited to names, locations, and any email addresses) that appears on the Website and Online Systems to infer consent to receive unsolicited commercial electronic messages or other communications.
Sign-On Credentials
- You may be required to register or sign-on as a user to access certain areas. You must ensure that you keep your sign-on credentials secret and do not disclose them – as you are responsible for all activities undertaken under your credentials.
- Notify TCA immediately of any unauthorised use of your sign-on credentials.
- You must not transfer your sign-on credentials without obtaining TCA’s permission.
Administrators
- If you are an administrator of the Website and Online Systems, you must:
- a. ensure recorded information is accurate and complete;
- b. maintain the security of your administrator sign-on credentials;
- c. comply with these Conditions; and
- d. ensure personal information is used in accordance with the TCA Privacy Policy.
No Liability for Content
- TCA may update content on the Website and Online Systems at any time without notice.
- The Website and Online Systems may contain links to external websites or systems. TCA is not responsible for, and will not be liable in respect of, their content or operation.
Breach
- If you breach these Conditions, TCA may block your access and deactivate your credentials.
General
- These Conditions may be updated from time to time. Continued use constitutes acceptance of any updates.
- These Conditions are governed by the laws of the State of Victoria, Australia, and you submit to its courts.

By using the Website and Online Systems, you agree that these Terms and Conditions, and Privacy Policy, together with the Terms and Conditions outlined on the Tennis Australia website, collectively govern your access to and use of all related services and platforms.
